Martha Karua Challenges Anne Waiguru’s Governorship


Narc Kenya Party leader Martha Karua has filed a petition challenging Anne Waiguru’s election as Kirinyaga Governor.

She filed the petition on Tuesday at the Kerugoya High Court through her lawyer Gitobu Imanyara, saying the August 8 election was not free and fair.

It comes after the Supreme Court ruled that the election of President Uhuru Kenyatta for a second term was nullified.

The former Gichugu MP cited the ruling in her petition adding that the verdict delivered by Chief Justice David Maraga, who was supported by three other Supreme Court judges, set precedent.

She said the ruling affects the governor, senator, and MP elections.

“This election was held on the same day the IEBC conducted polls in the country,” Imanyara told journalists after they filed the petition.

Karua will on Friday seek the nullification of Waiguru’s victory on a preliminary point based on the findings of the Supreme Court.



She said if the court fails to nullify the election on the preliminary basis, she will be ready for the full hearing of her petition. The ex-legislator claims to have evidence of massive voter bribery at polling stations as she claims that her agents were barred from polling stations.

Martha Karua, who has since refused to concede defeat to the former Devolution Cabinet Secretary, claims the votes were not properly counted with the tallying of results not properly done by electoral officials.

“We disputed the counting and tallying and demanded a recount while the process was ongoing which the IEBC denied,” she stated.

She alleges in her petition the forgery of the form 37A used to transmit results from polling centers to the county tallying center. She further claims unauthorized persons manned voting centers.

Karua said evidence in her possession shows a count of 58,000 votes was illegally entered into IEBC’s KIEMS to aid Waiguru’s win.

IEBC, the county returning officer, Waiguru and Deputy Governor Peter Ndambiri are respectively listed as respondents in the case.

Waiguru won the Kirinyaga governorship with 159,606 votes to Karua’s 120,341.
